FREE CONSULTATIONS
As a provider of coaching, hypnotherapy, and other psychotherapeutic services, we provide free 30-minute consultations that you can participate in via Telehealth (see TELEHEALTH). The purpose of these consultations is for you and your therapist to jointly determine your needs in therapy and whether you will be a good fit for the services we offer. Free consultations are limited to one per new client.
These consultations are offered free of charge and are based on our availability. During these consultations, you have the opportunity to ask questions, voice any concerns, and determine your needs for engaging with therapy. You understand that these consultations are obligation-free, and if for any reason you decide not to proceed with purchasing any of our Individual Therapeutic Services, Programs, Courses, Products, or Materials, you are under no obligation to do so. You also understand that you are not required to use this free 30-minute consultation; you may book your first appointment without engaging with this offer.
You understand that this free consultation is not therapy. If you choose not to have this free consultation, this time will not be added at a later date to any paid session. Free consultations are only available to clients who are new to our services and who, in good faith, intend to explore their options for therapy further.
INDIVIDUAL THERAPEUTIC SERVICES
As a provider of coaching, hypnotherapy, and other psychotherapeutic services, we offer individual therapy sessions via TELEHEALTH. All consultations include therapy/coaching; no appointments consist solely of hypnotherapy.
Except for the Initial Consultation, which lasts 60–90 minutes, all follow-up sessions are up to 60 minutes. Please set aside this time and arrive promptly for your session. You will receive an email confirmation upon booking and reminder emails 48 hours and 2 hours prior to your appointment.
You acknowledge that due to the personalised nature of therapy and your individual needs, session durations may run under or over time at the therapist’s discretion and availability. If your session is shorter than the booked or paid time, we are under no obligation to refund any part of the session fee or provide “extra time” in a future session. Any disputes regarding session length should be raised in good faith with us (see DISPUTE RESOLUTION). While we strive to address concerns, booking a 60- or 90-minute session reserves this time exclusively for you and cannot be reallocated or recovered by another individual.
All appointments are scheduled and conducted according to Greenwich Mean Time and British Summer Time (UTC+01:00). If you are outside this time zone, it is your responsibility to select the correct time zone in the booking tool and accurately convert appointment times to avoid missed sessions. For assistance, visit http://www.timeanddate.com/. Failure to account for time zone differences resulting in a missed appointment will incur a cancellation fee (see RESCHEDULING, CANCELLATION, AND NO-SHOW POLICY).
Age Requirement: You must be at least 18 years old to access or use our Individual Therapeutic Services. By booking or attending a session, you confirm that you meet this age requirement.
PROGRAMS OF INDIVIDUAL THERAPEUTIC SERVICES
When engaging with INDIVIDUAL THERAPEUTIC SERVICES, you have the option to pre-purchase or sign up to a program of Individual sessions which reduces the per session cost. We reserve the right to update and/or change these rates from time to time.
You understand that there are a number of benefits to be had when committing to a program of sessions, which may include but are not limited to: (1) an increased level of commitment to the process, signalling to yourself that this is an important issue to dedicate your time and money to, and that you are 'all-in', (2) the opportunity for your therapist to structure and plan therapy to suit your needs with prior knowledge of the minimum time you will have together, (3) email support between sessions should questions arise, (4) overall reduced cost as compared with booking and paying session by session.
Upon purchasing in full, you understand that you are committing to the program of individual sessions in its entirety, and agree to not commit to this purchase if you do not in good faith intend to commit to or use all of the sessions. You understand that refunds are not provided for prepaid sessions (see REFUND/CANCELLATION OF SERVICES OR PRODUCTS POLICY). Any exception made to grant a refund will be done so on a case-by-case basis, and only under special or extraordinary circumstances at our discretion. Please also see COMMUNICATION GUIDELINES.
Prepaid sessions must be used within 4 months of purchase, unless in the case of exceptional circumstances which will be decided upon at our discretion. You understand that it is your responsibility to ensure that you use all of your prepaid sessions. Whilst we will endeavour to contact you in the event of outstanding sessions, the responsibility to ensure that you have booked and completed the sessions that you have paid for remains with you.
When you purchase a package of sessions, it is recommended you book your pre-paid consultations ahead of time to secure the most suitable times for you as availability cannot be guaranteed. As a guide your 1st, 2nd and 3rd sessions will be weekly, with your 4th, 5th and 6th session scheduled fortnightly.
After each session your progress will be reviewed and any changes to your therapy schedule will be discussed with your therapist. For example your therapist may recommend a larger gap between sessions.
Important: All prepaid sessions must be completed within 4 months of the purchase date unless exceptional circumstances apply and are agreed upon at our discretion.
PRACTITIONER TRAINING TERMS AND CONDITIONS
As part of our commitment to professional development, The Calm and Happy Gut offers Practitioner Training Programs ("Training Programs") designed to equip participants with specialised knowledge and skills. By enrolling in any Practitioner Training Program, you agree to the following terms and conditions:
Access to the Training Program
Upon enrolment, you will be granted access to a password-protected Program Area containing video lessons, audio recordings, written materials, templates, worksheets, and other resources related to the course content ("Program Area"). Access to the Program Area will remain active for the duration of the Training Program, but no less than 30 days from your enrolment date.
Should The Calm and Happy Gut decide to close or substantially modify the Program Area, you will be notified at least 30 days in advance and provided an opportunity to download core materials during this period.
Bonuses and Additional Materials
From time to time, bonuses, supplementary materials, or special promotions may be offered to participants enrolled in the Training Program. These offers vary by promotional period and are only guaranteed to be available at the time of your enrolment. The availability of bonuses throughout the Program’s lifespan is not guaranteed.
Payment and Refund Policy
Due to the immediate digital access provided upon enrolment, all payments for Practitioner Training Programs are final and non-refundable. By enrolling, you acknowledge and accept that no refunds or cancellations will be permitted once the purchase is completed.
Intellectual Property Rights
All training materials, including but not limited to videos, audios, written content, templates, and worksheets, remain the sole intellectual property of The Calm and Happy Gut. Your enrolment grants you a limited, non-transferable license to use these materials solely for your personal professional development.
You may not share, reproduce, distribute, or resell any part of the Training Program content without prior written permission.
Limitation of Liability
The Calm and Happy Gut makes no guarantees or warranties regarding specific results or outcomes from participation in the Training Program. Your success depends entirely on your individual effort, application, and commitment to the training materials. We accept no responsibility for any direct, indirect, or consequential damages arising from your use of the Program materials.
Cancellation and Termination
We reserve the right to suspend or terminate your access to the Training Program at our discretion, including but not limited to breaches of these Terms and Conditions or misuse of the content. In such cases, no refunds will be issued.
DUTY OF CARE
At The Calm and Happy Gut, we take DUTY OF CARE for all of our clients, staff, contractors, and anyone purchasing or engaging with our Individual Therapeutic Services, Programs, Courses, Products, Materials, Website, other Internet Content, and/or Social-Media Presence or Engagement very seriously.
The Department of Health and Aged Care states:
"The principle of duty of care is that you have an obligation to avoid acts or omissions, which could be reasonably foreseen to injure or harm other people. This means that you must anticipate risks for your clients and take care to prevent them coming to harm. Remember that harm encompasses both physical and emotional harm."
In keeping with the spirit of DUTY OF CARE, we commit to upholding the highest possible standards of ethical and safe practice, consistent with standards commonly outlined and observed within ethical codes of conduct in mental health professions and healthcare in the UK. This includes but is not limited to:
(1) taking all reasonable steps to ensure that the client does not suffer physical, emotional, or psychological harm during sessions; (2) taking all steps possible to ensure the non-exploitation of clients, including financially, sexually, emotionally, or in any other way; (3) taking all reasonable steps to safeguard client privacy and confidentiality; (4) ensuring that our staff and contractors do not mislead, misguide, or misdirect (either overtly by publication or covertly by omission) clients as to their level of competence, experience, or qualifications; (5) taking all reasonable steps to refer to other services as deemed appropriate or necessary for client wellbeing and safety; (6) ensuring that all staff or contractors continue to undertake appropriate and relevant education, professional development, and ongoing supervision to best serve their clients and deliver ethical and safe treatment; (7) committing to processes of continuous and frequent evaluation of clients’ progress to ensure that clients’ needs are best served, and to determine the ongoing efficacy of treatment, treatment trajectory, and/or the need for referral to other services.
Upon intake into an Individual Therapeutic Service or Program, you will be asked to fill out and submit an intake form so that we can gather important information regarding you, your needs, and your health history; please see our PRIVACY POLICY for more details. This form will be sent as a link in the Initial Consultation confirmation email and must be completed no later than 24 hours prior to your initial appointment. This provides critical preparation time for the practitioner and ensures your appointment time is utilised efficiently. We use this information, in part, to gauge the appropriateness of a therapeutic intervention. If hypnotherapy is not deemed safe or appropriate for an individual—for example, in known cases of psychosis, delusions, or hallucinations—this will be discussed, and alternative forms of therapy or referral will be offered or suggested.
Should we have any concerns, it is our right to seek further clarification from you or members of your treatment team (where applicable) to assess your suitability for therapy. In the event we need to contact another practitioner or member of your treatment team to confirm your suitability for treatment or some other aspect of your care, you will be notified and asked to sign an authorisation to release form, requesting permission to discuss your treatment for the benefit of the therapeutic process. You have the right to decline this authorisation; however, you understand that in such cases, treatment may not commence or may need to be discontinued.
Duty of Care in Practitioner Training
While our Practitioner Training Programs are designed to educate, support, and empower practitioners by providing comprehensive knowledge, skills, and resources, it is important to acknowledge that participation in the Training Program does not transfer, delegate, or replace your professional responsibility to uphold a duty of care toward your own clients.
The Training Program promotes high standards of ethical and safe practice consistent with those observed within regulated mental health and therapeutic professions in the UK. We commit to delivering educational materials and guidance that reflect best practice and encourage ongoing professional development, supervision, and adherence to the relevant ethical codes and professional standards in your field.
However, as a qualified or trainee practitioner, you retain full accountability and responsibility for the application, interpretation, and implementation of the knowledge and skills gained through the Training Program within your clinical practice. You must ensure that all services you provide to your own clients meet the standards of care required by your professional body and applicable legislation.
Participation in the Training Program is intended to enhance your competence and confidence but does not substitute the need for individual clinical judgment, ongoing supervision, or compliance with your profession’s duty of care obligations.
INFORMED CONSENT
The treatment relationship between you and your therapist is founded upon trust, informed mutual agreement, and consent. At the outset of treatment, it is your right to be fully informed about the nature of the therapeutic intervention and any possible outcomes. You have the right to ask questions and have any concerns answered regarding treatment interventions prior to starting therapy and at every stage throughout the process. We agree to communicate clearly and transparently any details or agreements relating to scheduling, fees, and other treatment obligations. We commit to doing this tactfully and humanely, with due regard for the realistic and therapeutic aspects of the relationship.
One major benefit of therapy may be the resolution of the concerns you bring to it. However, given the nature of psychotherapy and talk therapy, there may be times when difficult or challenging topics arise, which could cause distress. If you experience distress, it is your right to communicate this with your therapist and seek understanding, recognising that such moments are often a natural and integral part of therapeutic progress. You retain the right to discontinue therapy at any time for any reason. You also have the right to request a referral to other appropriate specialists. While we cannot guarantee to connect you with a specific specialist or service, we will endeavour to do so or offer suitable alternatives when possible and deemed necessary.
Consent to use hypnosis:
Proceeding with therapy sessions is deemed your consent to engage in hypnosis, with the understanding that you may cease the session at any time. Hypnosis is a focused state of attention, and you retain full control—you may choose to work with your therapist or stop hypnosis at any point, including during the hypnosis component of your treatment.
Legal matters and hypnosis:
By participating in the Individual Therapeutic Services, you agree to the following:
(1) If you have matters related to pending court action, you should seek legal advice before discussing these issues with your therapist.
(2) Your therapist will treat all details as confidential; however, your legal counsel may advise you on topics to exclude from hypnotherapy sessions in certain circumstances. It is your choice to disclose any topics to your therapist, and this disclosure confirms your informed consent for the therapy provided.
(3) If you have pending or ongoing legal matters, you may still receive therapeutic assistance, but hypnotherapy/hypnosis may be excluded from your care for those specific issues until you inform your therapist otherwise. Alternative therapeutic modalities such as Strategic Psychotherapy, Coaching, CBT, or NLP may be utilised instead. This approach aligns with legal restrictions in some jurisdictions (e.g., the “per se exclusion rule” concerning hypnotising witnesses and their testimony used in some US courts).
PERSONAL RESPONSIBILITY AND ASSUMPTION OF RISK
You agree that you are using your own judgment when you decide to use, purchase, or engage with any of our Individual Therapeutic Services, Programs, Courses, Practitioner Training, Products, Materials, Website, other Internet Content, or Social-Media Presence, and you agree that you are doing so at your own risk. All of the aforementioned are intended to provide guidance, information, education, and support to help you make informed decisions regarding your mental and physical health. However, you understand and accept that you assume all risks and that no results or outcomes are guaranteed in any way (see GUARANTEES AND WARRANTIES).
We uphold the principles and content outlined in our DUTY OF CARE and INFORMED CONSENT policies, and you understand and agree that by choosing to engage with any of our Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence, you are solely responsible for your actions, decisions, and results based on their use, misuse, or non-use.
We take every precaution to protect your confidential information (see PRIVACY POLICY & CONFIDENTIALITY), as well as the content and integrity of our online Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, and Social-Media Presence or engagement. However, due to the nature of the Internet, we cannot completely guarantee the security of your confidential information or the integrity of our services hosted by us, or transmitted through our website, email, or social media platforms (see SOCIAL MEDIA AND INTERNET). Therefore, we do not accept responsibility for any outcomes or consequences arising from your use, misuse, or engagement with our online Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence, including any involvement by third parties.
You understand that submitting any contributions or personal information through our online services is done entirely at your own risk. Although we take all reasonable steps to protect the content and integrity of our offerings, we make no assurances regarding the prevention of any loss, damage, or breach to you or to any other individual, company, or entity arising from your use of our online Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence. You agree to assume such risks.
MANAGING EXPECTATIONS
Throughout your engagement with any of our Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence or engagement, we commit to assessing your individual circumstances where relevant and providing appropriate therapy, guidance, or direction to meet your needs. We will endeavour to assess your progress and, when deemed necessary, refer you to other suitable sources or services.
One major benefit that may be gained from participating in our Individual Therapeutic Services, Programs, Practitioner Training, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence is the resolution of the concerns brought to therapy. Other possible benefits may include enhanced coping skills in marital, family, or other interpersonal relationships, as well as a deeper understanding of personal goals and values.
You acknowledge that a significant part of the benefits derived from any form of therapy or training arises from your commitment to the process. It is understood that misuse of products or services, prematurely ending treatment, or frequent rescheduling that leads to an interrupted, stop-start therapy or training process may adversely affect expected outcomes.
Psychotherapy, coaching, and training are collaborative endeavours, and the progress you make will depend significantly on your active participation and investment in the process.
TELEHEALTH
Telehealth is a form of healthcare delivery using technology as an alternative to face-to-face consultations. This includes, but is not limited to, videoconferencing, internet, and telephone. Since the Covid-19 pandemic began, Telehealth has become a widely accepted and common method for delivering therapy.
At The Calm and Happy Gut, we view Telehealth positively, as it offers several advantages, including reduced or eliminated risk of spreading Covid-19 (and other infectious diseases), elimination of travel time for clients, greater flexibility in practitioner availability, and increased access for those living in regional, remote, or geographically distant areas.
However, while Telehealth brings many benefits, it also introduces additional considerations, which we outline below.
TELEHEALTH – OUR RESPONSIBILITIES
All principles for delivering safe and effective therapy apply equally to Telehealth. This includes protecting your confidential information (see PRIVACY POLICY & CONFIDENTIALITY) and upholding our obligations regarding DUTY OF CARE and INFORMED CONSENT.
We also commit to facilitating Telehealth sessions in a way that ensures the experience and potential benefits are not diminished compared to face-to-face consultations. This means our clinicians will be fully prepared, with reliable technology and internet access, working in a quiet, private environment conducive to safe and effective therapy.
In the uncommon but possible event of technology or internet disruptions, we will take all reasonable steps to resolve the issue or provide alternative solutions. This may include restarting video calls or switching to phone sessions if both clinician and client agree.
If technical issues from our side significantly disrupt your session, we will work with you to find an alternative arrangement. Options may include rescheduling, extending the session time if both parties are available, offering a therapist-discretionary discount, or adding extra time to a future session if agreed. We ask that any difficulties and resulting arrangements be approached with patience, generosity, and a willingness to find satisfactory solutions for both parties. For further details, see DISPUTE RESOLUTION.
TELEHEALTH – YOUR RESPONSIBILITIES
All responsibilities you agree to when engaging with any Individual Therapeutic Services, Programs, Courses, or Products for face-to-face consultations also apply to Telehealth (see PERSONAL RESPONSIBILITY AND ASSUMPTION OF RISK).
When choosing Telehealth, you agree to prepare adequately for your session by ensuring you have reliable technology and internet access, in a quiet and private environment suitable for safe and effective therapy. Even if you are at home or elsewhere, the usual expectations for therapy still apply, including being appropriately dressed, not under the influence of alcohol or illicit substances, and refraining from consuming such substances during the session.
In the uncommon but possible event of technology or internet disruptions on your end, you agree to use all reasonable efforts to resolve the issue or provide alternative solutions, such as restarting video calls or switching to a phone session.
If technical issues from your side cause significant disruption, any decisions regarding session adjustments will be made at the therapist’s discretion. While we strive to be accommodating, you agree that the therapist’s decisions in these matters are final. We ask that any difficulties and arrangements be approached with patience, generosity, and a spirit of cooperation to find satisfactory solutions for both clinician and client. For more details, see DISPUTE RESOLUTION.
You acknowledge that while we take all reasonable steps to protect confidentiality, the use of technology for Telehealth introduces inherent risks. We recommend that you participate in sessions from a private, secure location with reliable internet access.
GUARANTEES AND WARRANTIES
While the outcomes of therapy cannot be guaranteed, we do commit to providing your treatment with the highest level of care, using the best available tools and resources within an ethical and compassionate framework. This commitment includes adherence to DUTY OF CARE, CONFIDENTIALITY, and referral to other health specialists when appropriate.
By choosing to work with us, you acknowledge that you are engaging in a process of self-exploration and self-healing, and that you are making a commitment to yourself. You agree that you are ready and willing to participate in treatment. It is your right and responsibility to raise any questions or concerns about the therapeutic process with us. Likewise, you have the right to discontinue your treatment, package, or program at any time if you feel the work is no longer suitable.
You understand and accept that your decision to engage with any of our Individual Therapeutic Services, Programs, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence is made after considering the suitability of these offerings for your needs and choosing this as the appropriate step for you.
Given the nature of therapy, we do not provide any guarantee or warranty regarding the specific outcomes, effectiveness, or duration of benefits from our Individual Therapeutic Services, Programs, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence or engagement.
RESCHEDULING, CANCELLATION, AND NO-SHOW POLICY
We understand that sometimes unforeseen circumstances arise. Nonetheless, when you make an appointment for any of our Individual Therapeutic Services, we ask that you agree to honour this appointment time in good faith and provide as much notice as possible if you need to cancel or reschedule.
You understand that if you cancel or reschedule your appointment with less than 24 hours’ notice, you will be billed for the full appointment fee or lose that prepaid session. If you fail to attend your appointment without notice, you will also be billed for the full appointment fee or lose that prepaid session. Your therapist’s discretion on these matters is final.
If you arrive more than 20 minutes late for your appointment, the session will be forfeited, and you will be charged the full session fee or lose that prepaid session.
You acknowledge that a missed or last-minute rescheduled/cancelled appointment represents a loss for three parties: you, who miss valuable therapy time; another client, who could have used that time; and the therapist, who has prepared for your session.
If either party cancels a session, we will reschedule at the earliest mutually convenient time. Should we be unable to provide the service at the agreed time, we will notify you as soon as possible and arrange an alternative session time.
TERMINATION OF THERAPY
When you engage with our Individual Therapeutic Services, there will inevitably come a time when your participation concludes or is paused until needed again. You have the right to terminate your participation in any of our Individual Therapeutic Services, Practitioner Training, Programs, Courses, Products, or Materials at any time, either through verbal discussion with us or by email.
You understand and agree that if you violate any of the terms set out in these Terms & Conditions, including posing a risk to yourself, others, our therapists, or our business, we reserve the right, at our discretion, to refuse or terminate your access to our Individual Therapeutic Services, Practitioner Training, Programs, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence—whether in whole or in part—at any time, without prior notice. Notification of such termination may be given verbally or by email to the address you provided upon purchase or engagement with our services.

Please ensure you have reviewed the privacy policy of our payment processor(s), as outlined in our Privacy Policy.
You agree to purchase our Individual Therapeutic Services, Practitioner Training, Programs, Courses, or Products only for yourself or for another person for whom you have obtained express consent to provide their personal and payment details.
You accept full financial responsibility for all purchases made by you or anyone acting on your behalf. You agree to use our offerings for legitimate, non-commercial purposes only, and not for speculative, fraudulent, or illegal activities.
Given the clear and explicit refund policy set forth in these Terms & Conditions (which you agreed to before completing any purchase), we do not tolerate or accept payment disputes, threats of disputes, or chargebacks through your credit card company.
We reserve the right to pursue payment for any overdue amounts by engaging collection agencies and may report delinquent payments to credit reporting agencies, either directly or via such agencies.
If you make purchases through affiliates or other merchants linked on or through our offerings, please be aware that your transaction and payment information will be handled by that merchant and their payment processors. All terms, conditions, and warranties related to those purchases, including refunds or disputes, are strictly between you and that merchant. We accept no responsibility or liability for any issues arising from these transactions.
Payment processors and merchants may have privacy and data collection policies that differ from ours. We disclaim any responsibility or liability for their independent practices.
In some cases, your purchase may be subject to additional terms from payment processors, merchants, or us that specifically govern that transaction. For details, please consult the merchant’s website or contact them directly.
By making a purchase, you release us, our affiliates, payment processors, and merchants from any claims or damages arising from your transaction or use of our website or content.
You are responsible for any fees or charges applied by your bank or payment processor, including currency conversion fees or international transaction charges.
DISCOUNTS AND SLIDING SCALE FEES
From time to time, we may offer discounts or sliding scale fees on our Individual Therapeutic Services, Practitioner Training Programs, Courses, or Products for those who produce evidence of financial hardship or difficulty in otherwise accessing our products or services. Any discount or sliding scale fee that is offered is strictly done so at our discretion, and should not be expected by you or by anyone engaging with our Individual Therapeutic Services, Practitioner Training Programs, Courses, or Products.
You understand that any discount or sliding scale fee offered or honoured in one payment transaction does not necessarily or automatically apply to future payments or transactions and that at any time, we may choose to revert to full-fee payments should your financial circumstances change, or we otherwise see fit at our discretion to do so.
It is your right to be informed of the payments that you are expected to make in the event of any such changes, and we agree to communicate this to you either verbally, via email, or both.
It is your right to terminate your engagement with any of our Individual Therapeutic Services, Practitioner Training Programs, Courses, or Products should you disagree with these payment terms, please see TERMINATION OF THERAPY AND TRAINING.
REFUND/CANCELLATION OF SERVICES OR PRODUCTS POLICY
Your satisfaction with our services, including but not limited to Individual Therapeutic Services, Practitioner Training Programs, Courses, Products, Materials, Website, other Internet Content, and/or Social-Media Presence or Engagement, is important to us.
When you choose to purchase, access, use, or engage with any of our services, training, or products, you do so with the understanding that extensive time, effort, preparation, knowledge, and care go into creating and/or providing these offerings. You understand that when you make a purchase or engage with any of our services, training, or products, we do not offer refunds except in exceptional circumstances, which may be determined at our discretion on a case-by-case basis.
In respect to Individual Therapeutic Services or Practitioner Training paid in advance or via payment plans, you understand that sessions or training content delivery may run under or over the anticipated or agreed-upon time at the discretion and availability of your therapist, trainer, or group. Our No Refunds policy extends to any circumstance in which your session or training delivery runs shorter than booked or paid for. We do not have an obligation to refund any part of the session payment or training fee, nor owe “extra time” in future sessions or training access. You agree that any dispute over session duration should be raised in good faith with us. While we commit to addressing concerns, this time or content has been committed exclusively to you and cannot be recouped or utilized by others.
Regarding Individual Therapeutic Services or Practitioner Training paid in full in advance, you understand you are entering this commitment voluntarily and agree to not purchase if you do not in good faith intend to commit to or use all of the sessions or training modules. Refunds are not provided for prepaid sessions or training. Any exception will be made only in special or extraordinary circumstances at our discretion. Please also see COMMUNICATION GUIDELINES.
Prepaid sessions must be used within 4 months of purchase unless exceptional circumstances are agreed upon at our discretion. You are responsible for scheduling and completing all prepaid sessions. While we will endeavor to remind you of outstanding sessions or training components, the responsibility to use what you have paid for remains with you.
If you wish to request a full or partial refund for any services, training, or products, please email us detailing your reason. We will carefully consider your request, and our decision will be final.
One exception to the No Refunds policy is if we, including therapists, trainers, providers, or affiliates associated with us, are unable to fulfill our obligations for your treatment for any reason. In such cases, you are entitled to a pro-rata refund for any unused services. For example, if you purchased a 6-session treatment program and after three used sessions the provider cannot continue, you would receive a refund for the remaining three unused sessions.
By using and/or purchasing any of our Individual Therapeutic Services, Practitioner Training Programs, Courses, Products, and Materials, you understand and agree that all sales are final except as outlined in this policy.
Upon termination by either party, we reserve the right to immediately refuse or terminate your access to any aspect of our Individual Therapeutic Services, Practitioner Training Programs, Courses, Products, Materials, Website, other Internet Content, or Social-Media Presence, including but not limited to our Website, email communications, Facebook groups, live webinars, conference calls, or any related communication methods at any time, without notice and at our sole discretion.
These Terms & Conditions, including all copyright, trademark, and intellectual property rights, disclaimers, limitations of liability, release of claims, and this REFUND/CANCELLATION OF SERVICES OR PRODUCTS POLICY, shall continue to apply after termination by you or us.
DIGITAL PRODUCT CANCELLATION / REFUND POLICIES
Due to the immediate delivery and nature of digital products, including downloads, online courses, and practitioner training programs, refunds are not provided. By purchasing digital products or enrolling in online training, you acknowledge and accept this policy. For more details on refunds related to other services, please see our REFUND/CANCELLATION OF SERVICES OR PRODUCTS POLICY.

SOCIAL MEDIA AND THE INTERNET
When you voluntarily submit or post any comment, testimonial, photo, image, video, or other submission to or for us via public social media forums or the Internet (including but not limited to Facebook, Instagram, Twitter, LinkedIn, and Google), you do so with full awareness of the public nature of these platforms and the inherent limitations around privacy and confidentiality. Specifically, you acknowledge the limitations of our responsibility in this regard; please also see PERSONAL RESPONSIBILITY AND ASSUMPTION OF RISK. You understand that by engaging with us via social media or the Internet, you assume full responsibility and agree not to hold us liable for any outcomes or consequences—positive or negative, intended or unintended—arising from this engagement.
By voluntarily submitting or posting content in these public forums, you grant us consent to incorporate your submission into our current or future Individual Therapeutic Services, Practitioner Training Programs, Courses, Products, Materials, Website, other Internet Content, and/or Social-Media Presence or Engagement. This consent includes granting us proprietary and intellectual property rights under applicable jurisdiction without further permission or compensation. However, you retain the right to request removal or retraction of your content at any time and for any reason. Upon such a request, we commit to taking action within 72 hours and will keep you informed should any delay or difficulty arise.
The above does not apply to private Facebook Groups we host or moderate. Within such groups, we will make all reasonable efforts to maintain the privacy of posts, comments, photos, videos, and other content shared, given the nature of social media. We commit to not sharing group content externally and expressly request group members uphold the same respect for privacy and confidentiality. Nevertheless, we disclaim responsibility for unauthorized sharing by third parties or group members. We do, however, reserve the right to remove any member who breaches privacy or group rules. You agree to these limits of responsibility.
Your participation in any Facebook group we manage is voluntary. You accept responsibility for your conduct and any consequences arising from your participation—positive or negative, intended or unintended. While we strive to foster a respectful and private environment, Facebook is a public platform, and we cannot guarantee absolute privacy or security. It is your responsibility to report problematic or offensive content or behaviour to us. We will endeavour to address concerns promptly, but we cannot accept liability for harm or offence caused. You acknowledge that written communication on social media may lead to misunderstandings and agree to approach such situations with openness, kindness, and generosity. If conflicts arise that cannot be resolved satisfactorily, you understand you may leave or disengage from the group as you wish.
Regarding our intellectual property publicly shared on social media (including but not limited to Facebook, Instagram, Twitter, LinkedIn, and Google), you may share or disseminate such content in good faith to positively engage others. However, you must not claim this content as your own work or use it for personal financial gain unless explicitly authorised through an affiliate relationship with us. When sharing, you are expected to acknowledge The Calm and Happy Gut as the rightful owner and not obscure or misrepresent ownership.
